Hardship license Eligibility by Conviction

The eligibility requirements and waiting periods for a hardship license vary based on your DUI history:

First Conviction:

  • Complete enrolment in an approved DUI school
  • May be required to install an Ignition Interlock Device (IID)
  • Eligible to apply for a hardship license immediately upon meeting requirements
  • Hardship license permits driving to and from work, school, medical appointments, and other essential activities

Second Conviction within 5 years:

  • Must serve a mandatory hard suspension period of one year before applying for a hardship license
  • Must complete DUI school at the level II programme
  • Must install an IID for the duration of the hardship period
  • Must attend regular court-ordered counselling and treatment
  • Must demonstrate sobriety — no drugs or alcohol for at least one year

Third Conviction:

  • Must wait two years from the date of conviction before applying for any hardship license
  • 10-year license revocation period
  • Mandatory IID and treatment requirements

Fourth or Subsequent Conviction:

  • Permanent revocation — no hardship license is available
  • Reinstatement through the court requires exceptional circumstances and is not guaranteed
