Why the Timing of Your BAC Test Is a Legal Issue

One of the most important — and most frequently misunderstood — scientific facts in DUI cases is that blood alcohol concentration does not peak the moment you finish your last drink. Alcohol continues to be absorbed from the stomach and small intestine into the bloodstream for anywhere from 30 minutes to 2 hours after consumption, depending on individual factors. This means your BAC may still be rising at the time of a traffic stop, and the reading from a breathalyser administered 30, 60, or 90 minutes after you stopped driving may be higher than your BAC actually was while you were on the road.

Factors That Affect When BAC Peaks

  • Food intake — eating before or during drinking slows gastric emptying, significantly delaying alcohol absorption and lowering the peak BAC reading. A person who drank on an empty stomach will reach peak BAC faster and at a higher level than a person who ate the same amount of alcohol with a meal.
  • Body weight and composition — alcohol distributes into body water, not fat. A person with more body water (typically higher body weight and male physiology) will have a lower BAC from the same alcohol consumption than a lighter person.
  • Sex-based differences — women generally produce lower quantities of alcohol dehydrogenase, the enzyme responsible for initial alcohol metabolism in the stomach. This leads to higher and longer-lasting BAC compared to men consuming the same amount.
  • Rate of consumption — drinks consumed rapidly result in a faster and higher BAC peak than the same quantity consumed slowly over several hours.
  • Carbonation — carbonated mixers (soda, sparkling wine) accelerate gastric emptying, causing alcohol to be absorbed more quickly and BAC to peak sooner.

Retrograde Extrapolation — The Prosecution's Calculation and How to Challenge It

When a significant amount of time passes between a DUI stop and the breath or blood test, prosecutors sometimes attempt to calculate what the defendant’s BAC must have been at the time of driving — a process called retrograde extrapolation. This involves working backwards from the test result using an assumed elimination rate for alcohol.

Retrograde extrapolation is highly contestable. The accuracy of the calculation depends on knowing exactly when the defendant stopped drinking, their personal elimination rate (which varies significantly between individuals and cannot be reliably assumed), the timing and content of their last meal, and whether they were in the absorption or elimination phase at the time of testing. Rusty Shepard challenges retrograde extrapolation evidence by attacking the assumptions underlying the prosecution’s calculation and presenting evidence of the specific variables — food, timing, individual physiology — that undermine the claimed BAC at the time of driving.

The Intoxilyzer 8000 — Florida's Approved Breathalyser

Florida uses the Intoxilyzer 8000 as its approved breath testing instrument. Accuracy of the Intoxilyzer 8000 result depends on:

  • Operator certification — the officer administering the test must hold current certification. Lapsed or expired certification is grounds for suppression.
  • Instrument inspection and calibration — the device must be inspected on a regular schedule using certified reference solutions. Inspection records are discoverable.
  • Observation period — Florida requires a 20-minute observation period before the breath test to prevent mouth alcohol contamination from burping, belching, or recent drinking. Failure to maintain this observation is grounds to challenge the result.
  • Mouth alcohol — residual alcohol in the mouth from dental work, acid reflux, or recent drinking can produce falsely elevated results that do not reflect true BAC.
  • Partition ratio variation — the Intoxilyzer 8000 converts a breath sample to a blood alcohol equivalent using a standard 2100:1 partition ratio. Individuals with lower partition ratios will be overrepresented by the device.
