No Charges Aggravated Assault
ALLEGATION: Client arrested for drive-by shooting and was facing the possibility of a minimum mandatory 15 year prison sentence under Florida’s 10-20-Life Law. RESULT: After consulting with with prosecutors and law enforcement NO CHARGES WERE FILED.
Negotiated Plea DUI Manslaughter
ALLEGATION: Client charged with DUI Manslaughter. Client faced up to 15 years prison and a permanent loss of his drivers’ license. RESULT: Client entered negotiated plea to probation and is eligible to drive with a hardship license.
Not Convicted Sexual Battery
ALLEGATION: Client who holds a professional certification and license with the State of Florida was accused of Sexual Battery with the possibility of 15 years prison and mandatory “Sexual Offender” designation. Arrest was reported in the Panama City News Herald. RESULT: Charge reduced without consent of victim to simple battery (misdemeanor). Client NOT CONVICTED of any criminal offense and not designated a Sexual Offender. Client able to return to work without loss of professional certification and license
Client NOT CONVICTED Violation of Probation
ALLEGATION: Client violated probation for a second time by failing to report (“absconding”), committing a new crime of Battery, not completing DUI school and failing to complete court ordered community service hours.
Not Convicted Violation of Probation
ALLEGATION: Client violated probation by failing to report (“absconding”) and committing a new felony of Obtaining a Controlled Substance by Forgery. Client was on probation for 7 counts of Obtaining a Controlled Substance by Fraud, 6 counts of Forgery, and 6 counts of Criminal Use of Personal Identification.
Sex Offender Registration in Florida
Life on the Registry
Florida has one of the most stringent sex offender registration regimes in the United States. Registration is public, permanent for most offenses, and comes with restrictions on where you can live, work, travel, and conduct everyday activities. For many people convicted of sex crimes in Florida, the registration itself — not the prison sentence — is the most lasting and devastating consequence of the conviction.
Rusty Shepard’s primary goal in every sex crime case is to avoid a conviction that triggers registration. When a conviction cannot be avoided, he works to minimise every element of the penalty, including whether the designation is offender or predator.
Two Designations — Sex Offender vs Sexual Predator
Florida maintains two separate designations under its sex offender registration law, each with different consequences:
Sex Offender — the standard designation for most sex crime convictions. Registration is typically lifetime. Requirements include:
- Registration in person with the local sheriff’s department within 48 hours of release from prison or custody
- Reporting every six months (twice yearly) with current address, employer, vehicle, email addresses, social media, and phone numbers
- Immediate re-registration within 48 hours if any registered information changes (address, employment, vehicle)
- Annual in-person registration for lifetime
Sexual Predator — a more severe designation, reserved for violent sexual offenses or repeat sexual offenders. Requirements include:
- Registration every three months (quarterly) in person
- All sex offender restrictions apply, plus additional reporting obligations
- A flashing caution sign displayed on the FDLE online registry adjacent to the predator’s entry
- The predator designation cannot be removed or reclassified — it is permanent regardless of subsequent behavior
Florida Residency Restrictions — The 1,000-Foot Rule
Florida Statute § 775.215 prohibits any registered sex offender (where the victim was under 16) from residing within 1,000 feet of:
- Schools — including all K–12 public and private schools
- Daycare centers and childcare facilities
- Parks and playgrounds
- School bus stops
In a city like Panama City, these restrictions can make it practically impossible to find lawful housing. Many sex offenders find themselves unable to live in the areas where they have family, employment, or support networks. Violation of the residency restriction is a Third Degree Felony.
Employment Restrictions
Where the victim of the sex crime was a minor, a registered sex offender may not work at:
- Schools, tutoring centers, or other educational facilities
- Daycare or childcare facilities
- Parks, playgrounds, or recreational facilities where children gather
- Any business primarily serving or employing children
Failure to Register — A Separate Felony
Failure to properly register, update registration information, or comply with any registration requirement is itself a crime in Florida — a Third Degree Felony, carrying up to 5 years in state prison and a $5,000 fine. A second failure-to-register conviction is a Second Degree Felony.
Interstate and International Travel Restrictions
Registered sex offenders in Florida who intend to travel outside the state for more than three days must notify the sheriff’s department at least 21 days before travel. International travel is subject to similar notification requirements and, depending on the destination country’s laws, may be refused entry based on sex offender status.
